Terms of Service

VoiceAct is operated by Paul Schwarz, Rudolf-Waisenhorn-Gasse 27/11, 1230 Wien, Austria ("we", "us"). These terms apply to the website, the studio and every other part of the VoiceAct service. By creating an account or using the service you agree to them. If you use VoiceAct for a company, you confirm that you may bind it to these terms.

You must be at least 18 years old to create an account.

VoiceAct turns text into speech with AI voices: preset voices, voices designed from a written description, and cloned voices made from a recording you upload. All audio is generated by machine-learning models running on hardware we operate. Results vary: the same text can sound different each time, and the models occasionally mispronounce or garble words, especially in languages other than English. Please listen before you publish.

We keep improving the service and may change, add or remove features. Some features are marked as beta and may change faster or stop.

Keep your login safe; you are responsible for what happens in your account. Tell us at support@voiceact.ai if you think someone else is using it. One person may not run several free accounts to get around the free limits.

• Credits: generating speech uses credits. One character of text uses one credit; in Chinese, Japanese and Korean one character uses three credits. Each generation uses at least 25 credits. The studio shows the cost before you generate.
• Free credits: accounts without a plan get 3,000 credits each calendar month, topped up the first time you use or view them in that month. Unused free credits don't carry over. Free generations are limited to 500 credits each. Without an account you can try three short generations a day.
• Voice cloning is available on paid plans and to anyone who has made a purchase (for example a credit pack).
• Subscriptions (Starter, Creator, Studio) add credits every month. Unused subscription credits carry over up to three times the monthly amount. They end when the subscription ends.
• Credit packs are one-off purchases. Their credits do not expire while your account exists, and they stay when a subscription ends.
• Lifetime plans (Lifetime Starter, Lifetime Creator) are a one-off payment for the stated monthly credits for the operational lifetime of VoiceAct. They are sold in a limited number of seats. Each month the credits are topped up to the monthly amount; unused credits don't accumulate. If we ever shut VoiceAct down, we tell you at least 60 days in advance, and if your purchase was less than 24 months earlier, we refund the share of the 24 months that remains (for example, after 6 months: 18/24 of the price). A Lifetime Starter plan can be upgraded to Lifetime Creator by paying the difference while Lifetime Creator seats are available.
• A subscription and a Lifetime plan together: both monthly amounts add up, and the higher plan's features apply. If you buy a Lifetime plan while subscribed, you choose before paying whether the subscription stops at the end of its period, is canceled right away with a refund for the current period (the smaller of the unused time and the unused share of that period's characters), or keeps running. When a subscription ends, its unused credits expire; your Lifetime plan's monthly credits stay.
• Credits have no cash value and can't be transferred or paid out.

Who sells to you: purchases are sold by our authorised reseller, a Stripe company, which acts as the merchant of record. Its name appears on the checkout page and on your receipt. The reseller handles payment, invoices, VAT, cancellations and refunds under its own buyer terms, which you accept at checkout; they also describe your statutory right of withdrawal. Prices include VAT.

Our refund promise on top of your statutory rights: within 14 days of purchase we refund credit packs you haven't used, and Lifetime purchases with less than 10,000 characters used. Write to support@voiceact.ai with your receipt.

You can cancel a subscription at any time in your account ("Manage subscription"). It then runs until the end of the period you have paid for. Plan changes take effect as shown before you confirm them.

You may not use VoiceAct to create or spread audio that:

• imitates a real person's voice without their permission, or pretends to be someone you are not;
• is used for fraud, scams, phishing calls or to get around voice-based security checks;
• deceives people about elections, public figures or news events, or presents fabricated statements of real people as real;
• is sexual content involving a real person without their consent, or any content involving minors in a sexual way;
• harasses, threatens, defames or incites hatred or violence against people;
• infringes others' rights (for example copyright or personality rights) or breaks the law.

You also may not remove or tamper with the AI marking described below, overload or attack the service, scrape it or access it by automated means except through features we offer for that, resell access to it without our written permission, or use the service or its audio to build or train a competing speech model.

Where the law requires it, tell your audience that your audio is AI-generated. This applies in particular to realistic audio that resembles real people ("deepfakes") under the EU AI Act.

Only upload recordings of your own voice, or of a person who has given you explicit permission to clone their voice for your intended use. Before each upload you confirm this; we record that confirmation together with the time, your IP address and the recording, so we can deal with complaints.

If someone tells us their voice was cloned without permission, we may ask you to show the permission, and we may disable the voice and the audio made with it while we look into it.

Your texts and recordings remain yours. You give us the rights we need to process them in order to provide the service (storing them, generating audio and showing you your history). We do not use your texts, recordings or audio to train AI models.

You may use the audio you generate for private and commercial purposes, as long as you follow these terms and the law. AI-generated audio may not be protected by copyright in every country, and similar audio may be generated for other users; we don't promise exclusivity.

As required by the EU AI Act, every file and live stream we generate is marked as AI-generated: with an inaudible watermark in the audio and, in downloaded files, with signed metadata (C2PA Content Credentials). The marking doesn't affect how the audio sounds. Please don't remove it.

We aim to keep VoiceAct running smoothly but can't promise uninterrupted availability. Maintenance, high demand or problems with our hardware can cause delays or outages. Failed generations don't use credits.

You can delete your account at any time. We may suspend or close accounts that break these terms, especially the acceptable use and voice cloning rules, and remove content that breaks them. Where reasonable, we tell you first and give you a chance to respond. If we close your account without a good reason, unused paid credits are refunded.

We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breaches of essential obligations and only for typical, foreseeable damage. Mandatory consumer protection rights, including statutory warranty, are not affected. You are responsible for how you use the audio you generate.

If we change these terms, we tell you by email or in the app at least 30 days before the changes take effect. If you don't agree, you can cancel before then. Changes required by law or that only benefit you can take effect immediately.

Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, you keep the protection of the mandatory laws of the country where you live, and you can bring claims in the courts there.
